By your purchase and/or use of a Troy Belt product, you expressly agree and acknowledge:

Payment and Legal terms:

In the event of untimely payment, we impose an interest charge of 1.5% per month (18% annual rate) from the due date on you invoice until it is paid in full. Any payments made on past due amounts are applied first to the oldest outstanding invoice. You are responsible for payment of our attorneys’ fees and expenses for any collection activities. Exclusive venue shall be in Broward County, Florida and you hereby agree to personal jurisdiction in any court in Broward County, Florida, USA and agree to waive any challenge to forum non-convenience or motion to seek a change in location/venue or to lack of jurisdiction.

Limited Warranty and Limited Liability:

Troy Belt, LLC (“Troy Belt”) provides specific and limited warranties with respect to the product. All warranties applicable to the product are listed herein and no other warranties are offered with respect to the product, and Troy Belt has not authorized any employee or agent to offer any other warranties. 

The warranties referenced are expressly in lieu of any other warranties, expressed or implied, including without limitation any warranty of merchantability or fitness for particular purpose, and in lieu of any other obligations or liability on the part of Troy Belt. Troy Belt neither assumes (nor has authorized any person to assume for it) any other warranty nor liability in connection with the products.

NEITHER TROY BELT, LLC NOR ANY PERSON ON ITS BEHALF HAS MADE OR MAKES ANY EXPRESS OR IMPLIED REPRESENTATION OR WARRANTY WHATSOEVER, INCLUDING ANY WARRANTIES OF: (i) MERCHANTABILITY; (ii) FITNESS FOR A PARTICULAR PURPOSE; (iii) TITLE; (iv) NON-INFRINGEMENT; and/or (v) PERFORMANCE OF PRODUCTS TO STANDARDS SPECIFIC TO THE COUNTRY OF IMPORT, WHETHER ARISING BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. CUSTOMER ACKNOWLEDGES THAT IT HAS NOT RELIED ON ANY REPRESENTATION OR WARRANTY MADE BY TROY BELT, LLC OR ANY OTHER PERSON ON ITS BEHALF, EXCEPT AS SPECIFICALLY ON THIS PAGE.

Troy Belt shall have no liability for any consequential, incidental or special damages by reason of any act or omission or arising out of or in connection with the products, including without limitation any loss of use, lost revenues, lost profits, damage to associated equipment and other goods and services or to facilities, costs of substitute products, costs associated with down time, any similar and dissimilar losses, costs or damages. TROY BELT, LLC’S MAXIMUM LIABILITY FOR ANY REASON IS COST TO REPLACE THE ACTUAL PHYSICAL BELT AT ISSUE AND NOT INSTALLATION, REMOVAL OR ANY OTHER LABOR OR EFFORT TO REPLACE OR OTHERWISE. IN OTHER WORDS, TROY BELT, LLC WILL PROVIDE A NEW BELT OR REIMBURSE THE COST OF THE BELT AT ISSUE, AT ITS SOLE DISCRETION.

Instruction for Proper Use:

  • Unroll the Troy Belt;
  • Wrap it around the upper one third of the crown shaft of the subject palm;
  • Place the loop on the buckle;
  • Pull loose end to tighten the Troy Belt; and
  • Carefully trim excess strap;
  • Be sure to follow regular maintenance schedule for replacement and removal of dead fronds.
  • Troy Belt must be removed and replaced regularly or tree damage will occur. 

Instructions for Proper Removal:

  • Use caution to maintain distance from palm fronds as you prepare to remove the Troy Belt.
  • Carefully cut the Troy Belt in order not to damage the tree. Strap cutter is recommended. 

CAUTION:

THE PRODUCT IS ONLY INTENDED TO BE USED PER THE INSTRUCTION FOR PROPER USE AND ONLY ON SELF CLEANING PALM TREES. The belt should be removed within 3 months or when to avoid damage to any trees. THE BELT SHOULD BE PROPERLY REMOVED, AS DETAILED ABOVE, TO AVOID ANY HARM TO ANY PERSON OR THE TREE. ANY PERSON CLIMBING OR USING ANY METHOD OF GAINING HEIGHT TO PLACE OR REMOVE THE BELT SHOULD MAKE SURE TO BE PROPERLY SECURED, ENSURE THE AREA IS SAFE (AT THE DESIGNATED HEIGHT AND BELOW), AVOID WORKING IN DANGEROUS WEATHER AND FOLLOW THE INSTRUCTIONS AND WARNINGS PROVIDED BY THE SELECTED METHOD OF GAINING HEIGHT. FRONDS ARE HEAVY AND CAN WEIGH IN EXCESS OF 90 LBS. MAKE SURE YOU ARE WORKING IN A SAFE AREA THAT IS CLEAR OF ANY PERSON OR PROPERTY BELOW THE TROY BELT.
